Overview

As the law affects all kind of business activities, learning about the law as a non-lawyer is vital for everyone working in business. There are serious legal consequences for failing to comply with the law which in turn can impact upon business profitability and value. Understanding the law will enable students to appreciate how businesses are set up, to understand business risks, and to seize upon business opportunities, while also recognising when professional legal advice might be required. This unit covers essential topics in the Australian business world, including the Australian legal system, the law of contract, consumer protection, and the law of torts (including negligence as it affects business and as it applies to professionals). The law of business organisations, including the law of agency, partnerships, and an introduction to company law, will also be covered.

Learning outcomes

On successful completion of this unit, you should be able to:

understand how the Australian legal system, the law of contract, consumer protection law, the law of tort, and the law of business organisations affect the conduct of business

examine common legal scenarios in business relating to these areas of law, and apply relevant laws to predict possible legal outcomes

demonstrate an understanding of legal reasoning

consolidate and apply learning outcomes 1, 2 and 3 in several topic areas affecting business in one assessment task. This goal is reflected in the requirement that students must attain a mark of at least 45% on the final examination.

Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per semester typically comprising a mixture of scheduled learning activities and independent study. Independent study may include associated readings, assessment and preparation for scheduled activities. The unit requires on average three/four hours of scheduled activities per week. Scheduled activities may include a combination of teacher directed learning, peer directed learning and online engagement.
